Terms of use

These terms are a binding agreement between you and Seventh Planet Global Industries ("we", "us") covering your use of the Specter mobile app and its related services (the "App"). By downloading or using the App, you agree to them. If you do not agree, do not use the App.

1. Specter is entertainment, not science

Read this first

This is the most important term in this document. Please read it.

Specter is a work of interactive entertainment and atmospheric fiction. It is designed to feel like a paranormal investigation. It is not a scientific instrument and does not detect, measure, contact, or communicate with ghosts, spirits, the dead, or any paranormal, supernatural, or otherwise unexplained phenomenon. No such capability is claimed, implied, or supported by evidence.

Specifically, and without limiting the above:

  • Readings are not measurements of the paranormal. Where the App displays EMF, temperature, motion, or similar readings, these are derived from your phone's ordinary consumer sensors and/or generated for dramatic effect. They are not calibrated, are not fit for any scientific, diagnostic, safety, occupational, or professional purpose, and must not be relied on to assess any real-world condition or hazard.
  • "Spirit" words and replies are fiction generated by software. Every word the Ovilus surfaces, and everything that happens during an encounter, is selected by algorithms running on your device. If a conversational mode is offered in a future version, its replies would be generated by an artificial intelligence language model. Either way the output is invented. It is not a message from any deceased or non-physical entity, it may be inaccurate, nonsensical, eerie, or unsettling, and it is not advice of any kind.
  • Encounters are scripted to occur. Encounters are triggered by timers and randomness inside the App, not by anything present in your surroundings.
  • Do not rely on the App for any decision. Never use Specter as a basis for a decision about your health, safety, property, finances, relationships, legal position, or beliefs, or to make claims about any location or person.

If anything in the App's fiction is upsetting to you, please stop using it.

2. Eligibility

You must be at least 13 years old, or the minimum age of digital consent where you live if that is higher, to use the App. If you are under 18, you may use the App only with the involvement of a parent or guardian who agrees to these terms. You must have the legal capacity to enter into this agreement.

3. Licence

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use one copy of the App on devices you own or control, for your own non-commercial entertainment, in accordance with the rules of the app store you got it from and these terms.

You may not: copy, modify, translate, or create derivative works of the App; reverse-engineer, decompile, or disassemble it except where that right cannot lawfully be restricted; rent, lease, sell, sublicense, or distribute it; remove or obscure any proprietary notice; use it in any commercial paranormal-investigation service, broadcast, or paid performance without our written permission; circumvent or tamper with the free-tier limits, subscription checks, or unlock-code system; use automated means to access our servers; or use the App to break any law.

4. Specter Pro subscriptions

The App is free to use with rate limits. Specter Pro removes those waits.

Plans and prices. Specter Pro is offered as an auto-renewing subscription: $4.99 per month or $29.99 per year (USD; local prices and currencies are set by the app store and shown in the App before you buy).

Auto-renewal. Your subscription renews automatically at the end of each billing period, and your store account is charged the then-current price, unless you cancel at least 24 hours before the period ends. The charge is taken within 24 hours before the period ends.

Cancelling. Manage or cancel your subscription in your store account settings — on iOS, Settings → your name → Subscriptions; on Android, in the Google Play app under Payments and subscriptions. We cannot cancel a subscription for you. Cancelling stops future renewals; you keep Pro until the end of the period you have paid for. Deleting the App does not cancel a subscription.

Free trials and introductory offers. Where offered, any unused portion of a free trial is forfeited if you buy a subscription during the trial. Eligibility is determined by Apple or Google.

Price changes. If we change the price, the new price applies only from your next renewal, and only after the store has given you the notice and any consent step it requires. You can cancel before then.

Payment and refunds. All purchases are processed by Apple or Google, not by us. We do not receive or handle your payment details, and we cannot issue refunds. Refund requests are handled entirely by the store under its own policy — for Apple, via reportaproblem.apple.com; for Google, via Google Play support. You may also have statutory cancellation or withdrawal rights under your local consumer law, which these terms do not affect.

What Pro includes. Pro removes the free tier's cooldown on Ovilus responses and on starting recordings. It is not a purchase of any specific content, and features may be added, changed, or removed over time as described in section 10.

5. Unlock codes

We sometimes issue promotional unlock codes granting free access to Pro features. Codes are single-use, have no cash value, are not for resale, may be limited in duration, and may be revoked if obtained or used improperly. Redeeming a code requires verifying an email address so the grant can follow you between devices. Promotional access is not a purchase and carries no refund entitlement.

6. Recordings — your legal responsibility

The App can record audio and capture your screen. You are solely responsible for how you use that.

  • Recording laws vary and are strict. Many jurisdictions require the consent of every person being recorded. Do not record any person without the consent the law where you are requires. You are responsible for knowing and following those laws.
  • Do not record where recording is prohibited, including many museums, historic sites, private venues, workplaces, and places of worship.
  • Recordings you make are yours. They stay on your device; we neither receive nor store them (see the Privacy Policy). If you share them, you are responsible for what you share and for any rights and consents needed.
  • If a future version lets you type a question to a spirit, you are responsible for what you submit. Do not submit anything unlawful, abusive, or infringing, or anything personal or confidential about yourself or anyone else.

7. Your safety — please take this seriously

Paranormal investigation often means dark, unfamiliar, and derelict places. The App gives you no protection and no awareness of your surroundings.

  • Never trespass. Only investigate places you have a legal right to be in, with the permission of whoever controls them. The presence of a location in the App's list of known haunted sites is not permission to enter it, and many such sites are private, restricted, or dangerous.
  • Do not use the App while driving or operating machinery, or while walking in traffic or near hazards, water, heights, or unstable structures.
  • Watch your surroundings, not your screen. Do not follow any prompt, word, or reading from the App into a place or situation you would not otherwise enter.
  • Bring a light, tell someone where you are going, and do not investigate alone in unsafe places.
  • The App may produce sudden sounds, flashing visuals, and vibration. If you are sensitive to these, or have a photosensitive or heart condition, or are pregnant, consider whether use is appropriate for you and consult a professional if unsure.
  • The App is not an emergency tool. It cannot summon help. In an emergency, call your local emergency number.

You use the App at your own risk and take full responsibility for where you go and what you do while using it.

8. Intellectual property

The App, its name, logo, design, text, audio, prompts, word lists, location write-ups, Field Guide content, and code are owned by us or our licensors and are protected by copyright, trade mark, and other laws. These terms grant you no rights in them beyond the licence in section 3. Historical facts about real public locations are not claimed as ours, but our descriptions of them are.

Your recordings remain yours; we claim no rights in them.

9. Third-party services

The App relies on Open-Meteo (the outdoor temperature reading), Cloudflare (hosting), RevenueCat (subscriptions), Resend (verification email), and Apple or Google (payment and distribution). If a conversational spirit mode is offered in a future version, it would additionally rely on an AI provider to generate replies. Your use is also subject to these providers' terms where applicable. We are not responsible for their acts, omissions, availability, or content. Features that depend on them may be interrupted, and section 10 applies.

10. Availability, changes, and termination

We may change, suspend, limit, or discontinue the App or any feature, including the online spirit-reply service, at any time, and may impose or adjust usage and rate limits. Where a change would substantially reduce what an active paid subscription provides, we will give reasonable notice and, where required by law, offer a pro-rata refund of the unused period through the relevant store.

We may suspend or terminate your access if you materially breach these terms, including by tampering with the subscription or unlock-code systems. You may end this agreement at any time by deleting the App; cancel any subscription separately as set out in section 4. Sections 1, 6, 7, 8, 12, 13, 14, and 16 survive termination.

11. Updates

The App may check for and install updates through your app store. Some features require the current version and a working internet connection. We do not guarantee support for older versions or older operating systems.

12. Disclaimer of warranties

The App is provided "as is" and "as available", without warranty of any kind. To the fullest extent permitted by law we disclaim all warranties, express, implied, and statutory, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.

Without limiting section 1, we specifically do not warrant that the App will detect or communicate with anything paranormal, that any reading, word, or reply is accurate, meaningful, calibrated, or true, that the App will be uninterrupted, secure, or error-free, or that any defect will be corrected.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. Nothing here excludes any non-waivable statutory consumer guarantee.

13. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost recordings, personal injury, property damage, trespass, arrest, emotional distress, or any loss arising from your reliance on anything the App displayed or from where you went or what you did while using it.

Our total liability for all claims relating to the App is limited to the greater of (a) the amount you paid us for the App in the 12 months before the claim, or (b) USD 50.

These limits apply regardless of the theory of liability and even if we were advised of the possibility of the loss. They do not apply to liability that cannot be limited by law, such as, in many places, death or personal injury caused by negligence, or fraud. Some jurisdictions do not allow these limitations, so they may not fully apply to you.

14. Indemnity

You agree to indemnify and hold us harmless from any claim, loss, liability, and reasonable legal cost arising from your use of the App, your recordings or shared content, your entry onto any property, or your breach of these terms or of any law — including any recording-consent, privacy, or trespass law.

15. Changes to these terms

We may update these terms. For material changes we will give notice in the App or by updating the date above before they take effect. Continuing to use the App after a change takes effect means you accept the updated terms. If you do not accept them, stop using the App and cancel any subscription.

16. Governing law and disputes

These terms are governed by the laws of South Carolina, United States, without regard to its conflict-of-laws rules. You and we agree to the exclusive jurisdiction of the courts located in Greenville, South Carolina, except that either of us may seek relief in any court with jurisdiction to protect intellectual property, and except where your local consumer law gives you the right to bring proceedings where you live, which we do not seek to remove.

Before starting any formal dispute, please contact us at developer@seventhpla.net so we can try to resolve it informally.

17. General

These terms, together with the Privacy Policy, are the entire agreement between us about the App. If any provision is held unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not assign this agreement; we may assign it in connection with a merger, acquisition, or sale of assets. Nothing here creates any partnership, agency, or employment relationship.

18. Apple App Store — additional terms

The following apply to the version obtained from the Apple App Store and, where they conflict with anything above, prevail for that version.

  1. This agreement is between you and us only, not Apple. Apple is not a party to it and is not responsible for the App or its content.
  2. Scope of licence. Your licence is non-transferable and limited to use on any Apple-branded device you own or control, as permitted by the Usage Rules in the Apple Media Services Terms of Service, except that the App may be accessed by other accounts via Family Sharing or volume purchasing.
  3. Maintenance and support. We are solely responsible for any maintenance and support, as stated in these terms or required by law. Apple has no obligation to provide any maintenance or support for the App.
  4. Warranty. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to any warranty are our sole responsibility.
  5. Product claims. We, not Apple, are responsible for addressing any claim by you or a third party relating to the App or your use of it, including product liability claims, any claim that the App fails to conform to a legal or regulatory requirement, and claims under consumer protection, privacy, or similar law, including in connection with the App's use of HealthKit or HomeKit frameworks if applicable.
  6. Intellectual property claims. If a third party claims the App infringes its intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement, and discharge of that claim.
  7. Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  8. Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these terms and have the right to enforce them against you.
  9. Contact. Questions, complaints, or claims about the App should be directed to developer@seventhpla.net.
